Going to the jury trial, pro se….. Need a pointer?
I want to attack the validity of a stop, or whether a stop occurred, and put that trial strategy before a jury. I filed a motion to dismiss, the State responded, and I replied. The basis of the motion is briefly explained below…I am going to a jury, pro se, friday and I want to raise an issue before a jury, arguing I was stopped, and stopped illegally. The State will may object, or respond that no stop occurred and that the stop was mutual, as they did in response to my dismissal motion. ATV Decal I predict the officer would testify that the stop was mutual, and that he stopped to visit. I want to argue that the stop was illegal, and that the officer had no legal reason to stop me. (A huge factual dispute as I see it.) …the court denied my motion to dismiss, without oral arguments or an evidentiary hearing.I was cited for failure to decal my ATV, a misdemeanor. It’s not much of fine and there is no jail time for the offense, like $50 max. I really do feel the officer stopped me, he had no particularized suspicion to do so, and such was illegal. How would I tell a jury this?Montana law provides that the decal must be displayed in a conspicuos spot (this is not at issue, at this point). He approached me from the front, left, raised his hand, indicating he wanted me to stop. I stopped my ATV and he immediatley dismounted his ATV and moved in front of mine, from left to right. I seen he was an officer by his uniform, gun, and badge. He introduced himself as an officer and he initiated conversation. At conclusion he noticed i didn’t have a decal and issued me a ticket.
